Overview

Welcome to Big Rocket Project! The terms “we”, “us” and “our” refer to Big Rocket Project di Vesentini Marco. Big Rocket Project operates this store and website, including all related information, content, features, tools, products and services, in order to give you, as a customer, a carefully made shopping experience (the “Services”). Big Rocket Project is powered by Shopify, which is what allows us to provide the Services to you.

The terms and conditions set out below, together with any policy referred to here (these “Terms and Conditions of Service” or “Terms”), describe your rights and responsibilities when you use the Services. Please read these Terms carefully, as they contain important information about your legal rights.

Sales through the Site are made only to Italy and the countries of the European Union. Orders from countries outside the EU will not be accepted. The professional services we offer to individuals and businesses (B2B commissions, contract manufacturing, custom projects) are not sold through the Site and are governed by separate agreements entered into case by case.

By visiting, interacting with or using our Services, you agree that these Terms and Conditions of Service and our Privacy Policy apply. If you do not accept these Terms or the Privacy Policy, you must not use or access our Services.

Section 1 — Access and account

By accepting these Terms, you confirm that you are of legal age in your State or Region of residence, and that you have given us your consent for any minors in your family to use the Services on devices that you own, buy or manage.

To use the Services, including accessing or browsing our online stores or buying any product or service we offer, you may be asked to provide certain information, such as your email address and your billing, payment and shipping details. You represent and warrant that all information you provide in our store is correct, current and complete, and that you hold all rights necessary to provide it. You are solely responsible for keeping your account credentials secure and for all activity carried out on your account. You may not transfer, sell, assign or license the account to third parties.

Section 2 — Our products

We have made every effort to represent our products accurately in our online stores. Please bear in mind, however, that product colours or appearance may differ from how they look on your screen, because of the type of device you are using and its settings.

Our products are largely handmade or printed to order. Small variations in colour, finish, shade and gloss, the presence of knots, grain and small natural imperfections in the materials (wood, brass, metals), micro-bubbles, slight asymmetries and minimal dimensional differences within manufacturing tolerances are typical of these processes. They are what makes a handmade product unique and do not constitute a lack of conformity.

Product descriptions may change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time and to limit the quantities we offer.

2.1 Product categories

  • A) Print on Demand (POD) — Merchandise (clothing, accessories, gadgets) made to order. As these are personalised goods or goods made to the customer’s specific order, they are excluded from the right of withdrawal under art. 59(1)(c) of the Italian Consumer Code (Codice del Consumo).
  • B) Handmade products in stock — Handmade items held in stock. Subject to the ordinary right of withdrawal and to the legal guarantee of conformity.
  • C) One-off pieces and limited editions — Works and items produced as a single example or in limited runs, held in stock. Subject to the right of withdrawal on the conditions set out in Section 6.
  • D) Digital products — Digital content supplied by immediate download after payment. Excluded from the right of withdrawal under art. 59(1)(o) of the Italian Consumer Code, subject to the customer’s express consent at the time of purchase.

Section 3 — Orders

The contract of sale is concluded when we send the customer, at the email address given during the order, the order confirmation setting out the items purchased, the total price, the shipping address and the payment details. Payment must be received and processed before the order is accepted.

Please check your order carefully before you submit it. We reserve the right not to accept orders that are incomplete, incorrect or irregular, or for which the availability of the Product cannot be guaranteed; in that case we will inform you promptly and refund in full anything you have already paid. Purchases are subject to return or exchange in accordance with our Refund and Returns Policy and to the right of withdrawal set out in Section 6.

Section 4 — Prices and invoicing

All prices shown on the Site are in Euro (€) and include every applicable tax or duty. Shipping costs are shown separately and calculated at checkout according to the destination and the Product; for some products the product page may state “Shipping included”.

The Seller operates under the Italian flat-rate tax regime (regime forfettario) pursuant to art. 1, paragraphs 54-89, of Law 190/2014. The prices shown are the final amount payable by the customer. The price applied to each order is the one shown on the Site at the time the order is submitted.

Prices, discounts and promotions may change without notice. Promotions may be governed by separate terms; in the event of conflict, the terms of the promotion prevail. You represent and warrant that you are authorised to use the payment method you provide and that your payment information is true, correct and complete.

Section 5 — Shipping and delivery

The Seller ships to Italy and the countries of the European Union; costs and times may vary according to the country of destination. Delivery times are indicative and run from confirmation of payment:

  • Print on Demand: 5-10 working days
  • Handmade products in stock: 5-10 working days
  • One-off pieces and limited editions: 5-10 working days (for bulky products, times may be longer and will be communicated separately)
  • Digital products: immediate download after confirmation of payment

The times given are estimates and are not binding. We are not liable for delays caused by couriers or by events outside our control, except as provided by art. 61 of the Italian Consumer Code.

The risk of loss of or damage to the Products passes to the customer when the customer (or a third party designated by the customer, other than the carrier) takes physical possession of the Products, pursuant to art. 63 of the Italian Consumer Code. On delivery, check that the parcel is intact: if there is obvious external damage, refuse the delivery or accept it subject to inspection, and tell us promptly at ping@bigrocketproject.com, attaching photographs of the damaged parcel.

Section 6 — Right of withdrawal

For Products subject to the right of withdrawal (categories B and C), a consumer customer has the right to withdraw from the contract without penalty and without giving a reason, within 14 days of the date on which the Product was received, pursuant to arts. 52 et seq. of the Italian Consumer Code.

Exclusions (art. 59 of the Italian Consumer Code): withdrawal does not apply to Print on Demand Products (category A), to Digital Products (category D) whose supply has begun with the customer’s express consent, or to any sealed products which were unsealed after delivery for reasons of hygiene.

To exercise the right of withdrawal, send an express notice within 14 days of receipt to ping@bigrocketproject.com, or use the model withdrawal form (Annex A). The Product must be returned within 14 days of that notice, in its original condition, in intact packaging and complete with accessories, labels and any certificates of authenticity, to: Big Rocket Project di Vesentini Marco, Via XXV Aprile 76 — 37014 Castelnuovo del Garda (VR) — Italy. The cost of return is borne by the customer.

The customer is liable for any diminished value of the Product resulting from handling other than what is necessary to establish its nature, characteristics and functioning (art. 57(2) of the Italian Consumer Code). For one-off pieces and limited editions (category C), any use, assembly, display, modification, damage or wear beyond what is necessary for that inspection will diminish the value, and we will take that into account when refunding — up to 100% of the value of the Product in the most serious cases.

The refund will be made within 14 days of our receiving the notice of withdrawal, using the same payment method you used, unless otherwise agreed. We may withhold the refund until we receive the Product, or until you provide evidence that you have sent it back, whichever is earlier (art. 56(3) of the Italian Consumer Code).

Section 7 — Legal guarantee of conformity

All Products sold to consumer customers are covered by the legal guarantee of conformity for 24 months from the date of delivery, pursuant to arts. 128-135-septies of the Italian Consumer Code. Where a product does not conform, you are entitled, at your choice, to have conformity restored by repair or replacement or, where the conditions are met, to an appropriate price reduction or to termination of the contract. To make a claim under the guarantee, contact us at ping@bigrocketproject.com, describing the defect and attaching photographs and a copy of your proof of purchase. The variations inherent in handmade products described in Section 2 do not constitute a lack of conformity.

Section 8 — Intellectual property

Our Services, including all trade marks, brands, text, images, graphics, video and audio, as well as their design, selection and arrangement, belong to Big Rocket Project or to its licensors and are protected by Italian and European law on copyright, trade marks and other intellectual property rights. These Terms allow you to use the Services for personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, republish, download or transmit any material on the Services without our prior written consent. The Big Rocket Project names, logos, designs and slogans are our trade marks and may not be used without prior written consent. The Shopify name and logo are trade marks of Shopify. All other trade marks appearing on the Services belong to their respective owners.

Section 9 — Resale of the Service

Users are not permitted to reproduce, duplicate, copy, sell, resell or exploit this Site or the Services, in whole or in part, without our prior written consent, given either directly or through a legitimate reseller programme. This provision is in addition to, and does not limit, Section 8 (Intellectual property).

Section 10 — Optional tools

You may be given access to third-party tools which we neither monitor nor control. Such tools are provided “as is” and “as available”, without any warranty. You use them at your own risk and discretion, and you should review and agree to the terms on which their respective providers supply them. Any new features offered in future will be subject to these Terms.

Section 11 — Third-party links

The Services may contain materials and links to third-party websites. We are not responsible for examining or evaluating the content or accuracy of third-party materials or websites. If you choose to visit such sites, you do so at your own risk; review their policies before entering into any transaction. Complaints about third-party products and services must be addressed to that third party.

Section 12 — Relationship with Shopify

Big Rocket Project is supported by Shopify, and this is what allows us to provide the Services to you. All sales and purchases made in our store, however, are made directly with Big Rocket Project. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales between you and Big Rocket Project, including any damage, injury or loss arising from the products and services purchased. You hereby expressly release Shopify and its affiliates from any claim, damage or liability arising out of or connected with your purchases and transactions with Big Rocket Project.

Section 13 — Privacy policy

All personal data we collect through the Services is subject to our Privacy Policy, and some personal data may be subject to Shopify’s own privacy policy. By using the Services, you confirm that you have read our policy. Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them, including by transmitting it to third parties which may be in a country other than your own. See our Privacy Policy for further details.

Section 14 — Feedback

If you send us ideas, suggestions, feedback, reviews, proposals or other content (together, “Feedback”), you grant us a perpetual, worldwide, sublicensable, royalty-free licence to use, reproduce, modify, publish, distribute and display that Feedback in any medium and for any purpose, including commercial use. You represent and warrant that you hold all rights necessary in the Feedback, and that it does not infringe the rights of third parties and contains no unlawful, defamatory or obscene content or malware. We are under no obligation to keep Feedback confidential, to pay any compensation or to reply. We may, without being obliged to, monitor, edit or remove Feedback that we consider unacceptable. You may not use a false email address or mislead us as to the origin of any Feedback.

Section 15 — Errors, inaccuracies and omissions

Occasionally the information on the Services may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, promotions, shipping costs, transit times and availability. We reserve the right to correct such errors and to change or update information, or to cancel orders, at any time and without notice, including after an order has been submitted — refunding, in that case, anything already paid.

Section 16 — Prohibited uses

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or harmful purpose; (b) to breach any regulation, rule or law; (c) to infringe our intellectual property rights or those of third parties; (d) to harass, abuse, defame, intimidate or harm any person; (e) to transmit false or misleading information; (f) to transmit unsolicited advertising material, spam or similar solicitations; (g) to impersonate any person or entity; (h) to upload viruses or malicious code; (i) to collect other people’s personal data; (j) to scrape the Services or use automated means to access them; or (k) to interfere with or circumvent the security features of the Services. We reserve the right to suspend, disable or terminate an account at any time if we determine that any part of these Terms has been breached.

Section 17 — Interruption and availability of the Service

To keep the standard of service as high as possible, we reserve the right to interrupt the Service for maintenance, system updates or any other change, giving users appropriate notice where possible.

Within the limits of the law, we also reserve the right to suspend or discontinue the Service entirely. Should the Service be discontinued, we will make arrangements for users to extract their personal data and information, and we will respect users’ rights regarding continued use of the product and/or compensation, as provided by law.

The Service may also be unavailable for reasons outside our reasonable control, such as force majeure (for example infrastructure failures, blackouts and the like). None of the above affects the mandatory rights of consumer customers or our obligations in respect of orders already confirmed.

Section 18 — Disclaimer of warranties and limitation of liability

The information presented on the Services is made available for general information purposes, and the Services are provided “as is” and “as available”. To the fullest extent permitted by law, we give no warranty that your use of the Services will be uninterrupted, timely, secure or error-free.

Nothing in these Terms limits or excludes the mandatory rights you have as a consumer under the Italian Consumer Code (Legislative Decree 206/2005) and applicable Italian and European law, including the right of withdrawal, the legal guarantee of conformity, and the Seller’s liability for wilful misconduct or gross negligence. The limitations of liability in these Terms therefore apply only to the extent permitted by law and do not affect those rights.

Section 19 — Indemnity

You agree to indemnify and hold harmless Big Rocket Project, Shopify and their respective affiliates, employees, agents and service providers from any loss, damage, liability or claim, including reasonable legal costs, arising from (1) your breach of these Terms, (2) your breach of any law or of the rights of third parties, or (3) any use of the Services that does not comply with these Terms. This provision does not affect the mandatory rights of consumers.

Section 20 — Complaints

Complaints and requests for information may be sent to ping@bigrocketproject.com or by certified email (PEC) to bigrocketproject@pec.it; we undertake to reply within a reasonable time and in any event within 30 days. Consumer customers remain free to turn to the alternative dispute resolution (ADR) bodies provided for by arts. 141 et seq. of the Italian Consumer Code, or to the competent court.

Section 21 — Severability

If any provision of these Terms is held to be unlawful, void or unenforceable, that provision will apply to the fullest extent permitted by law and the unenforceable part will be treated as severed from these Terms, without affecting the validity of the remaining provisions.

Section 22 — Waiver; entire agreement

Our failure to exercise or enforce any right or provision will not constitute a waiver of that right or provision. These Terms and any policy we publish in relation to the Services constitute the entire agreement between you and us and govern your use of the Services, superseding any prior agreement or communication.

Section 23 — Assignment

You may not transfer or assign this agreement or any right or obligation under these Terms without our prior written consent, and any attempt to do so will be void. We may transfer or assign these Terms and our rights and obligations, provided that doing so does not reduce the safeguards you enjoy as a consumer.

Section 24 — Governing law and jurisdiction

These Terms are governed by Italian law. For any dispute arising out of these Terms, the competent court is that of the place of residence or domicile of the consumer customer, if located in Italy, pursuant to art. 66-bis of the Italian Consumer Code. For consumer customers resident in other EU countries, the rules of private international law on consumer protection apply. For disputes with professional customers, the courts of Verona have exclusive jurisdiction.

These Terms are drafted in Italian and translated into English for the customer’s convenience. In the event of any discrepancy between the two versions, the Italian version prevails, without prejudice to the mandatory rights available to consumer customers under the law of their country of residence.

Section 25 — Headings

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

Section 26 — Changes to the Terms and Conditions of Service

You can consult the Terms in force at any time on this page. We reserve the right to update, change or replace any part of these Terms by publishing the updates on our site. We will inform you of any material change in accordance with applicable law. Orders already confirmed at the time of a change remain governed by the Terms in force on the date the order was submitted.
